These Terms of Use govern your access to and use of the Website.

By accessing or using the Website, you agree to be bound by these Terms of Use. If you do not agree with these Terms of Use, you must not use the Website.

These Terms of Use apply only to use of the Website. The supply or use of RemSense software, platforms, technology, data, professional services or other products or services may be subject to separate agreements, licence terms, proposals or other contractual arrangements.

2. Website Content

The Website contains information about RemSense, our technology, software, platforms, services, projects, capabilities and other matters.

Unless otherwise stated, Website content is provided for general information purposes only. It does not constitute engineering, technical, financial, investment, legal or other professional advice and should not be relied upon as a substitute for advice appropriate to your particular circumstances.

Information, demonstrations, visualisations, models, screenshots, videos, images, specifications and examples shown on the Website may relate to particular projects, operating environments or configurations and may not represent the functionality, performance or results available in every circumstance.

5. Intellectual Property

Unless otherwise indicated, all intellectual property rights in or relating to the Website and its content are owned by or licensed to RemSense.

This includes, without limitation, rights in:

• software and source code;
• virtualplant and other software platforms;
• user interfaces and functionality;
• proprietary processes, workflows and methodologies;
• 3D models and visualisations;
• photographs, video, imagery and graphics;
• LiDAR, photogrammetry and other visual data where owned by RemSense;
• drawings, diagrams and technical material;
• text and publications;
• databases and data structures;
• trademarks, logos and branding; and
• inventions, designs, know-how and other technology.

Nothing in these Terms of Use transfers ownership of any intellectual property to you.

Where Website material includes information, imagery, data or intellectual property belonging to a customer, partner, licensor or other third party, ownership remains with the relevant rights holder.

6. RemSense Names, Products and Trade Marks

The names RemSense, RemSense Technologies, virtualplant, associated logos and other product, service or technology names used by RemSense are trademarks, registered trademarks or proprietary branding of RemSense or its licensors.

You must not use these names, marks or logos in advertising, promotional material, publications, domain names, social media accounts, products or services without our prior written consent, except for legitimate references to RemSense that do not suggest sponsorship, affiliation or endorsement.

Third-party names and trademarks appearing on the Website remain the property of their respective owners. Their appearance does not necessarily indicate sponsorship, endorsement or affiliation.

7. Customer and Project Material

The Website may contain examples of projects, customer applications, digital models, asset imagery or other material relating to work undertaken by RemSense.

Such material is provided for illustrative purposes only and may have been simplified, edited, anonymised or reproduced with permission.

The inclusion of customer or project material on the Website does not give you any right to copy, extract, reproduce, use or distribute that material.

Nothing on the Website alters intellectual property ownership, confidentiality obligations, data ownership or licence rights agreed between RemSense and its customers or partners under separate agreements.

The Website may provide access to demonstrations, previews, screenshots, videos or descriptions of RemSense software and technology.

Unless expressly stated otherwise, access to a demonstration or description does not:

1. grant a licence to use RemSense software or technology;

3. guarantee that displayed functionality will be included in a particular product, project or implementation; or
4. override or amend any separate software licence, subscription, proposal, statement of work or services agreement.

You submit to the non-exclusive jurisdiction of the courts of Western Australia and courts entitled to hear appeals from those courts.
